Sam turned it into a game. In "Name That Payout," hosts Elliott and Jessica heard what an insurer initially offered on a real, anonymized case, then guessed the final result from three options.

## A first offer is a starting position, not a valuation

The adjuster who calls you sounds helpful. That call is still math. Claims close faster and cheaper when the injured person doesn't yet know what the injury will cost. Sign the release and the claim is over - and not accounting for the surgery you find out you need in October.

Sam's message on air was plain: understand what your case is worth before you sign anything.

## Three things that quietly decide what you're paid in Nevada

Insurers know all three. Most injured people don't.

The clock. Under[NRS 11.190(4)(e)](https://www.leg.state.nv.us/nrs/nrs-011.html), you generally have two years from the date of injury to file a personal injury or wrongful death lawsuit in Nevada. When that deadline passes, so does your leverage.

The fault split. Nevada follows modified comparative negligence under[NRS 41.141](https://www.leg.state.nv.us/NRS/NRS-041.html#NRS041Sec141). Your recovery is reduced by your share of fault - and if your share is 51% or greater, you recover nothing. Every percentage point an adjuster pins on you comes off your check.

The policy. Since July 1, 2018, Nevada's minimum liability coverage has been[25/50/20](https://doi.nv.gov/Consumers/Automobile_Insurance/Higher_Minimum_Vehicle_Liability_Requirements/) - $25,000 per person, $50,000 per accident, $20,000 in property damage. A serious injury clears that in days. None of that is printed on the paperwork the adjuster emails you.

## Should you talk to a lawyer before accepting a settlement offer?
