Do I need a lawyer for an accident if I was the passenger?
Insurance claims aren’t just for drivers. Pedestrians, bicyclists, and passengers who are injured in car accidents are also entitled to compensation. But being a passenger in a car accident can leave you with a lot of questions. Where exactly is your place in a personal injury claim?
In most cases, passengers do not cause car accidents. Passengers rely on others’ driving. If your own driver was at fault in the accident, it’s best to hire an attorney and pursue a claim on the driver’s insurance policy. Pursuing a claim is not personal – it’s about starting a process that provides compensation for your injuries.
What if I am partly at fault for my accident?
In Nevada, you can partly be at fault for an auto collision and still recover compensation. Nevada follows a “modified comparative negligence” law that allows accident victims to recover payment for damages as long as they are not more than 50% at fault. When this is the case, the victim’s compensation is reduced by his or her percentage of fault.
So, for example, you suffer $100,000 in damages in a car wreck, but you are found to be 10% at fault for your crash. Your compensation would be reduced by $10,000 (10% of $100,000).
What should you do after a car accident in Las Vegas?
After a car crash in Las Vegas, take the following steps to protect your health and preserve your right to seek compensation for your injuries and other losses.
