We’re Here To Help
If you’ve been injured in a motorcycle accident in Nevada, you already know how quickly things can change. Insurance companies often blame motorcyclists — assuming reckless riding or relying on outdated stereotypes — to minimize or deny your claim.
The reality is that most Nevada motorcycle crashes are caused by other drivers who fail to see riders, don’t yield the right of way, or change lanes without checking blind spots. As experienced Nevada motorcycle accident lawyers, we fight back against unfair blame and insurance tactics so you can focus on healing while we handle the legal battle.
At Sam & Ash Injury Law, we’ve helped hundreds of injured riders across Las Vegas, Reno, Henderson, and throughout Nevada secure the compensation they deserve.
Filing A Claim
Once you’ve addressed your immediate medical needs, the next step is pursuing compensation through an insurance claim or lawsuit. Here’s what the process typically involves and why timing matters:
Nevada’s Statute of Limitations
In Nevada, you generally have two years from the date of the motorcycle accident to file a personal injury lawsuit. Missing this deadline usually means you lose the right to seek compensation. There are limited exceptions (such as the discovery rule in rare cases where injuries appear later), but it’s best not to wait.
The Claims Process
- Insurance claim — We first pursue a claim against the at-fault driver’s insurance company. This often includes negotiating for medical bills, lost wages, and pain and suffering.
- Lawsuit if needed — If the insurance company denies your claim, offers an unfair settlement, or delays, we file a lawsuit in the appropriate Nevada court.
- Investigation & evidence — Our team gathers police reports, witness statements, accident reconstruction (when helpful), medical records, and expert testimony to build a strong case.
At Sam & Ash Injury Law, we handle the entire process for you—from the initial claim filing through settlement negotiations or trial—so you don’t have to deal with the paperwork, deadlines, or insurance pressure.
Don’t let the clock run out. The sooner you contact us, the stronger your Nevada motorcycle accident claim can be.

What To Do After
Take these important steps to protect yourself after a motorcycle accident:
Call 911
Responders will secure the area, control the situation, and prepare an official report, ensuring proper documentation for any necessary follow-up.
Save All Evidence
Take photo and video of the scene. Store reports, important items, and any records securely so nothing useful to your case is lost or misplaced.
Seek Medical Attention
A prompt exam can uncover unseen injuries and create important documentation for your claim
Follow Your Doctor’s Instructions
Attend all follow-up appointments, complete recommended treatments, and participate in any necessary therapies.
Report the Accident
If the incident occurred in public, notify nearby people, business owners, or file an incident report.
Contact a Lawyer
Do not wait to get the legal advice you need. We can start investigating the accident, preserving evidence, and protecting you from day one.
Journal
Record detailed notes about how the accident occurred and track symptoms, treatments, and recollections related to your recovery process.
Limit Social Media
Refrain from posting about your incident—anything posted online could impact your claim.
Compensation For A Motorcycle Accident
A successful claim can help cover:
- Past and future medical bills, including surgery, rehabilitation, and ongoing care
- Lost wages and diminished earning capacity
- Pain and suffering
- Loss of enjoyment of life
- Loss of consortium (impact on your relationship with your spouse or family)
- Motorcycle repair or replacement costs
Our goal is to secure the full, fair compensation you need to move forward.
You May Be Entitled To Maximum Compensation

Answering Your Questions
Are motorcyclists more often at fault than car drivers?
Not usually. National Highway Traffic Safety Administration (NHTSA) data shows that in multi-vehicle crashes, passenger-vehicle drivers are far more often at fault in T-bone collisions and failure-to-yield situations — the two most common types of motorcycle crashes. Motorcyclists are only slightly more likely to be at fault in certain head-on or rear-end crashes. The majority of accidents result from other drivers simply not seeing the motorcycle.
My crash was caused by road debris, potholes, or poor road conditions. Do I still have a claim?
Yes. You may have a strong claim against the city, county, or state entity responsible for maintaining the roadway. Our team investigates these cases thoroughly and has successfully recovered compensation for clients injured by hazardous road conditions in Nevada.
I wasn’t wearing a helmet. Does that affect my ability to get compensation?
Nevada law requires all motorcycle operators and passengers to wear a properly fastened, DOT-approved helmet. Not wearing one does not prevent you from pursuing a claim against the at-fault driver. However, the insurance company may argue that your injuries were worsened by the lack of a helmet, which could reduce the portion of your damages related to head injuries under Nevada’s modified comparative negligence rules. We’ll fight to protect your full recovery.
What if I was partially at fault?
Nevada follows a modified comparative negligence rule. As long as you are less than 51% at fault, you can still recover compensation—though your award will be reduced by your percentage of fault. If you are 51% or more at fault, recovery is barred. Our attorneys work hard to minimize any fault assigned to you and maximize your compensation.
