Responders will secure the area, control the situation, and prepare an official report, ensuring proper documentation for any necessary follow-up.

Take photo and video of the scene. Store reports, important items, and any records securely so nothing useful to your case is lost or misplaced.

Uber and Lyft will not pay for losses in every accident. As a general rule, they compensate for accidents caused by the rideshare driver.

Whether Uber or Lyft will cover your accident — and how much — depends on what the driver was doing at the time:

  • Driver app is off: The driver’s personal insurance applies. Uber and Lyft provide no coverage.
  • Driver is available or waiting for a ride request: The driver’s personal insurance applies first. If that is denied or not enough, Uber and Lyft provide up to:
    • $50,000 for bodily injury per person
    • $100,000 for bodily injury per accident
    • $25,000 for property damage

Driver is en route or transporting a passenger: Uber and Lyft provide up to $1 million in third-party liability coverage. This includes uninsured/underinsured motorist coverage and coverage for hit-and-run accidents.

Uber and Lyft drivers are considered independent contractors, not employees. This means the companies don’t have the same legal responsibility as a traditional employer, like a taxi company.

In the past, this allowed Uber and Lyft to deny liability when their drivers caused accidents. Many victims were left without enough compensation because the driver’s personal insurance didn’t cover commercial use.

After public backlash, both companies now provide their own insurance coverage to protect passengers, other drivers, and pedestrians when an accident happens.

Compensation varies by case but can include current and future medical bills, lost income, diminished earning capacity, pain and suffering, and more. We’ve helped clients recover six- and seven-figure settlements, including full policy limits when appropriate.
