Filing A Claim After An Auto Accident
If you need to file a lawsuit after a car accident, you typically have two years from the date of the crash to do so. California law allows only a few exceptions to extend this deadline.
We can help you understand your legal options, guide you through the process, and make sure you don’t miss important deadlines.

What To Do After
To ensure a fair negotiation process with insurance providers and help you obtain your rightful compensation, here are some key steps to follow after a car accident:
Seek medical attention
The most crucial step is ensuring you receive appropriate medical attention. Even if injuries aren’t obvious, get checked by a doctor. Internal or head injuries may not show symptoms right away.
Follow your doctor’s instructions
Follow your doctor’s orders, including undergoing any prescribed diagnostic procedures like X-rays and MRIs, attending all the follow-up medical appointments, and taking adequate rest for complete recovery.
Save all evidence
Keep photographs and video footage from the accident scene, contact information for any witnesses, and all documentation related to your medical treatment, vehicle repairs, and other associated expenses. Additionally, keep copies of all correspondence with insurance companies in an accessible place for convenience and efficiency.
Limit social media
It’s common to share life events on social media, but after a car accident, posts could be misconstrued and used against you in the claim process. It’s safest to avoid sharing anything related to the accident on social media until your case is settled.
Contact a lawyer
Your attorney will gather essential evidence, manage your healthcare needs, and handle insurance companies to protect you from mistreatment.

Answering Your Questions
What should I tell the insurance company after an auto accident?
Don’t talk to the insurance company. It gives the claims adjuster an opportunity and ammunition to hurt your case. During these calls, insurance adjusters ask leading questions to obtain statements they can later use against you. Additionally, they pressure you to accept lowball offers.
After an accident, you don’t have all the information you need to get the settlement that’s right for you. That is why it is best not to speak with the insurance company. When you partner with Sam & Ash Injury Law, we will communicate your best interests and protect your claim from the adjuster.
Do I need an attorney after a minor car accident?
Not all car accidents require the help of a personal injury attorney, but you deserve answers. Even minor accidents cause injuries that should be compensated. For clear answers, get a free consultation from us. We’re available 24/7 to discuss What’s Right for you. No pressure, no hard sell — just the advice you need to help you move forward.
Do I need a lawyer for an accident if I was the passenger?
Insurance claims aren’t just for drivers. Pedestrians, bicyclists, and passengers who are injured in car accidents are also entitled to compensation. But being a passenger in a car accident can leave you with a lot of questions. Where exactly is your place in a personal injury claim?
In most cases, passengers do not cause car accidents. Passengers rely on others’ driving. If your own driver was at fault in the accident, it’s best to hire an attorney and pursue a claim on the driver’s insurance policy. Pursuing a claim is not personal — it’s about starting a process that provides compensation for your injuries.
What if I am partly at fault for my accident?
In California, you can partly be at fault for an auto collision and still recover compensation. California follows a “modified comparative negligence” law that allows accident victims to recover payment for damages as long as they are not more than 50% at fault. When this is the case, the victim’s compensation is reduced by his or her percentage of fault.
So, for example, you suffer $100,000 in damages in a car wreck, but you are found to be 10% at fault for your crash. Your compensation would be reduced by $10,000 (10% of $100,000).
