We’re Here To Help

Airbnb and other short-term rentals, like Vrbo, can be a convenient option, but these properties aren’t always held to the same safety standards as hotels. Poor maintenance or hidden hazards can put you at risk.

If you were injured at an Airbnb or similar rental, you may be unsure who is responsible — the property owner, the host, or the rental platform. We can help you sort through the confusion, hold the right party accountable, and secure compensation for your medical bills and other losses.

Filing A Claim For An Airbnb Injury

Property owners have a legal duty to keep their spaces safe for guests. If you’re injured at an Airbnb due to hazards like broken stairs, falling objects, fires, or poor security, the host may be held liable under Nevada’s premises liability laws. You typically have two years from the date of injury to file a claim.

If you were seriously injured at an Airbnb, it may be worth pursuing a claim. Airbnb offers Host Liability Insurance (HLI) with up to $1 million in coverage per incident for guest injuries or property damage. This applies to a wide range of rentals, from homes and condos to boats and buses.

However, there are exclusions — Airbnb’s policy won’t cover incidents involving assault by the host, vehicle or boat accidents, injuries from serving alcohol to underage guests, disease transmission, or loss of electronic data. In those cases, a claim may need to be filed through the host’s personal or business insurance.

What To Do After

You or a companion should take steps to establish preliminary evidence of liability for an accident that has occurred at an Airbnb property. You should:

Responders will secure the area, control the situation, and prepare an official report, ensuring proper documentation for any necessary follow-up.

Take photo and video of the scene. Store reports, important items, and any records securely so nothing useful to your case is lost or misplaced.

A prompt exam can uncover unseen injuries and create important documentation for your claim

Attend all follow-up appointments, complete recommended treatments, and participate in any necessary therapies.

If the incident occurred in public, notify nearby people, business owners, or file an incident report.

Do not wait to get the legal advice you need. We can start investigating the accident, preserving evidence, and protecting you from day one.

Record detailed notes about how the accident occurred and track symptoms, treatments, and recollections related to your recovery process.

Refrain from posting about your incident—anything posted online could impact your claim.

Premises liability is the legal duty property owners have to keep their space safe for guests. If you’re invited or have permission to be on the property, the owner must fix or warn you about any hazards. When they fail to do so and you’re injured, they may be held liable.

In Airbnb cases, this can involve serious injuries like broken bones, head trauma, or back injuries. Common hazards include:

  • Slip and falls
  • Structural collapses
  • Falling objects
  • Swimming pool accidents
  • Electrical issues
  • Fires
  • And more
