Under NRS 41.1395, a facility whose abuse or neglect injures an older person is liable for two times the actual damages — plus your attorney’s fees if the conduct was reckless or malicious.

What To Do If You Suspect Elder Abuse or Neglect

Taking the right steps early can protect your loved one and preserve evidence:

Responders will secure the area, control the situation, and prepare an official report, ensuring proper documentation for any necessary follow-up.

A prompt exam can uncover unseen injuries and create important documentation for your claim

Take photos or video of injuries, room conditions, bedsores, restraints, and any hazards. Write down dates, times, names, and what was said. Store reports, important items, and any records securely so nothing useful to your case is lost or misplaced.

Ask for care plans, incident reports, medication administration records, staffing logs, and facility communications.

If the incident occurred in public, notify nearby people, business owners, or file an incident report. Additionally, call (702) 486-6930 in Las Vegas / Clark County, or (888) 729-0571 from anywhere in the state of Nevada to report it to the Nevada Adult Protective Services.

Attend all follow-up appointments, complete recommended treatments, and participate in any necessary therapies.

  • Pressure sores that formed or worsened while repositioning went undocumented
  • Weight loss or dehydration where intake was never charted and nobody escalated
