Data from the National Highway Traffic Safety Administration shows that passenger vehicle drivers are more often at fault in T-bone accidents and crashes involving failure to yield, while motorcyclists are slightly more likely to be at fault in head-on and rear-end collisions.
That said, drivers of passenger vehicles often fail to see or anticipate motorcycles due to blind spots or inattention. This is a major factor in many motorcycle accidents involving driver negligence.
My accident was caused by road debris or uneven paving. Do I have a claim?
There’s a good chance you do. Not all motorcycle accident claims are against drivers of passenger vehicles. Public entities such as cities and states have an obligation to ensure road safety. Motorcycle accidents can result from oil slicks, potholes, uneven paving, and inadequate lighting.
