Sam Mirejovsky of Sam & Ash Injury Law Appears on Local Living: E-Bike & E-Scooter Liability and Safety Tips
Las Vegas, NV, January 2026: Sam Mirejovsky, co-founder of Sam & Ash Injury Law, joined Local Living to discuss the growing issue of e-bike and e-scooter collisions in Las Vegas, and who’s liable when things go wrong.
E-bikes and e-scooters have experienced a surge in popularity across Las Vegas, but so have collisions. UMC Trauma Center treated nearly 200 e-device injuries in 2025 alone, with several fatalities reported. Sam Mirejovsky, co-founder of Sam & Ash Injury Law, recently joined Local Living to explain Nevada e-bike and e-scooter laws, who’s liable in a crash, and essential safety tips for riders and drivers.
How Nevada Law Classifies E-Bikes & E-Scooters in 2026
- E-bikes (under 750 watts, max 20 mph assisted) are legally bicycles — no license, registration, or insurance required, but all traffic laws apply.
- E-scooters must use bike lanes when available and are banned from sidewalks in most areas.
- Nevada follows an at-fault system, where the party responsible for the collision is liable for damages, injuries, and losses.
If an E-Bike or E-Scooter Rider Causes the Crash
- The rider can be held fully liable for the other party’s medical bills, vehicle repairs, pain and suffering, and more.
- Most e-riders lack dedicated insurance — leaving them personally exposed. The injured party can sue the rider directly, potentially targeting wages, assets, or future earnings.
- Rider tip: Add liability protection through homeowners/renters policies or scooter-specific add-ons. It’s affordable and prevents financially devastating lawsuits.
If a Driver Hits an E-Bike or E-Scooter Rider
- Drivers must treat e-riders like bicyclists: yield right-of-way, maintain safe distance, and watch carefully for them.
- If the driver is negligent (distracted, failing to yield, speeding, etc.), their auto insurance covers the rider’s injuries, repairs, lost wages, and other damages.
- Minimum liability limits are $25,000 per person — often far too low for serious injuries like fractures, head trauma, or long-term rehab.
- Rider tip: Document everything — photos, witnesses, police report. Pursue the driver’s insurance or your own UM/UIM coverage if they’re uninsured.
Critical Safety Tips for E-Bike & E-Scooter Users & Drivers in 2026
- Drivers: Constantly scan for e-riders, especially at intersections, crosswalks, and in bike lanes.
- Riders: Always wear a helmet, use front white and rear red lights at night, obey all traffic signals, and avoid sidewalks.
- Both: If injured, contact a lawyer before speaking to insurance — we fight for maximum compensation, no fee unless we win.
