Sam Mirejovsky Tells Radar Why Suge Knight’s Silence May Not Stop the Tupac Trial
August 11, 2026 — Las Vegas, NV — Marion “Suge” Knight says he won’t testify against the man accused of killing Tupac Shakur in Las Vegas. Radar asked Sam & Ash Injury Law partner Sam Mirejovsky what that actually means for prosecutors — and his answer separates what the state can force from what the state can use.
Where the case stands
Jury selection began August 10 in Clark County District Court before Judge Carli Kierny. Duane “Keffe D” Davis, 63, faces one count of murder with use of a deadly weapon plus a gang enhancement, and has pleaded not guilty. Testimony is expected to run four to five weeks.
Knight was driving the BMW carrying Shakur when gunfire erupted near the Strip on September 7, 1996. Knight was wounded; Shakur died six days later at 25. Knight, now 61 and serving a 28-year California sentence on an unrelated conviction, remains the only known living eyewitness — and he’s on the state’s witness list.
Can prosecutors force Suge Knight to testify?
Yes. His consent isn’t the deciding factor.
“Knight is in California custody, so Nevada goes through the Uniform Act to Secure Attendance of Witnesses,” Mirejovsky told Radar. “A Nevada certificate, a California judge signs off, and he is produced or he testifies by video. Consent is not part of that process.”
That’s NRS 174.395–174.445 — a reciprocal procedure that lets one state reach a witness sitting in another. Getting him in the room, though, isn’t the same as getting an answer.
“Getting him on the stand is the easy part. Getting anything useful out of him is not,” Mirejovsky continued. “Contempt means nothing to a man serving twenty-eight years, and a hostile witness who blames the people who brought him is a gift to the defense.”
The larger lesson
Thirty years is a long time to wait on a court case. Witnesses harden. Memories blur. Footage disappears. Cases don’t get stronger sitting still, they get harder.
