Nevada Laws About Speeding

Nevada’s basic rule about speeding makes it illegal to drive:

  • At an unreasonable speed when considering traffic, the surface and width of the highway, weather, and other highway conditions
  • At a speed that could cause injury, death, or property damage
  • At a speed greater than the posted speed limit
  • At a speed of greater than 80 miles per hour.

Fines levied for a speeding ticket vary from county to county and city to city throughout Nevada. By law, a ticket can cost up to $20 for each mile per hour above the posted speed limit that the ticketed driver was traveling or the speed the driver should have been traveling.

In Las Vegas, a basic speeding ticket costs the driver $208 ($113 plus court costs). Speeding fines are automatically doubled if speeding occurs in a work zone, school zone, or pedestrian safety zone. Drivers also face a fine of up to $1,000 if they cause property damage or injuries while speeding or exceeding a safe speed.

A driver who is charged with speeding or driving too fast for conditions may face prosecution. But if you were seriously injured by a driver who was speeding, you will need to file a separate civil lawsuit holding the driver accountable for your financial losses.

Who Causes Speeding Accidents on Nevada Highways?

The Nevada Department of Public Safety says in its 2021 report that from 2015 to 2019, a total of 453 fatal speeding-related crashes occurred on Nevada roadways and caused 512 deaths. Of these fatal accidents related to speeding, 329 (72.6%) occurred in Clark County.Rear view woman driving a car carelessly uses a phone while driving at high speed, unable to keep the car on the path, causing an accident into a tree

Seventy percent of fatal speeding crashes occurred on urban roadways.

Male drivers ages 26 to 30 years old accounted for a third of drivers identified as at fault in fatal speeding crashes in Nevada from 2015 to 2019. Male drivers of all ages make up the vast majority of all drivers identified as at fault in speeding-related fatalities (82%).

Fatal speeding accidents were more likely to happen between 6 p.m. and midnight and more than half occurred on weekends (Friday to Sunday).

Fatal speeding crashes occurred as:

  • Single vehicles hitting fixed objects (30%)
  • Angle collisions (e.g., T-bone crashes) with another vehicle (21%)
  • Single-vehicle rollovers (15%)
  • Rear-end collisions (14%)
  • Collisions with pedestrians or nonmotorized vehicles such as bicycles, wheelchairs, and skateboards (8%)
  • Head-on collisions (5%)
  • Sideswipes/while passing (3%)
  • Other/unknown (2%)

Keep in mind that, in single-vehicle fatalities, any surviving passenger who was injured has the right to seek compensation for their losses through the late driver’s insurance coverage.

How Much Is My Speeding Accident Claim Worth?

The Insurance Institute for Highway Safety (IIHS), the organization that conducts crash tests, explains that increasing speeds increase the risk of crashes and the severity of crash injuries in four basic ways:

  • Higher speed increases the distance a vehicle travels between the driver’s recognition of an impending hazard and when the driver reacts.
  • As speed increases, the distance required for the vehicle to stop after the driver applies the brakes gets longer.
  • Speed increases the risk that an evasive steering maneuver will result in loss of control of the vehicle.
  • As speed increases, it exponentially increases the violent forces expended by the impact of a crash. For example, when impact speed increases from 40 to 60 mph (a 50% increase), the energy transferred upon impact increases by 125%.

At high speeds, the force of impact in a crash can be so severe that the structure of the vehicle collapses into the passenger compartment instead of protecting the driver and passengers. At very high speeds, airbags and safety belts cannot protect occupants from impacts causing severe injury, the IIHS says.

People injured in car accidents caused by speeding can face thousands of dollars of medical bills and lengthy recoveries during which they are unable to work and earn income. In a fatal speeding accident, families may lose their primary breadwinner and face expenses related to their loved one’s injury and death.

Our attorneys may be able to help those harmed in speeding accidents seek compensation for:

  • Medical costs. This includes emergency care, diagnostic tests, hospitalization, surgery, medication, rehab, and other costs of treating your injuries. In a wrongful death claim, the cost of any medical care administered before death may be recovered.
  • Future medical needs. Some serious injuries require ongoing medical care or delayed treatment. In cases of disabling injury, such as paralysis, we consult life care planning experts to project ongoing costs.
  • Lost income. An injury claim may seek compensation for the income you lost while you could not work and for diminished earnings if your injuries require you to take a lower-paying job. You may also seek compensation for the lost wages a deceased loved one would have contributed to their family’s well-being.
  • Property damage. This is typically the cost of repairing or replacing a motor vehicle.
  • Pain and suffering. Nevada law allows the unjustly injured to seek compensation for physical pain, physical impairment, disfigurement, inconvenience, and general loss of enjoyment of life.
  • Emotional distress. A claim may seek compensation for anxiety, depression, insomnia, or other psychological pain, including the loss of companionship of a loved one. Payment for the cost of counseling you need to help deal with the aftermath of the accident may be available, as well.
  • Final expenses. In a wrongful death, the family may claim compensation for reasonable funeral and burial expenses.
