We’re Here To Help
E-bike or e-scooter accidents can change everything in an instant. As their use grows across Las Vegas, Henderson, Reno, and throughout Nevada, so do the number of crashes resulting in serious injuries. Many crashes aren’t the rider’s fault. Drivers fail to yield, miss riders in blind spots, or drive distracted. Road hazards and reckless behavior also play a role.
At Sam & Ash Injury Law, we take on the insurance companies and handle every legal detail — so you can focus on recovery. Our team has helped injured riders across Nevada. Our goal is simple: secure every dollar you’re entitled to so you can focus on getting better. We fight, you recover.
Filing A Claim After An Accident
After getting medical care, the next step is securing compensation. In Nevada, you typically have two years from the date of the accident to file a personal injury lawsuit. If you miss this deadline, you likely lose your right to recover damages. Some exceptions exist, but acting early protects your case.
Here’s how the process works:
- Insurance claim — We file against the at-fault party medical bills, lost wages, and pain and suffering.
- Building your case — We collect police reports, witness statements, medical records, photos, and expert analysis to build the strongest case possible.
- Lawsuit, if needed — If the insurer denies, lowballs, or delays your claim, we take your case to court.
We manage the entire process for you — from day one through settlement or trial — so you can focus on recovery, not paperwork or insurers. Act quickly. The sooner you reach out, the stronger your claim.

Answering Your Questions
Who is liable in an e-bike accident in Nevada?
Whoever caused it — and most of the time, that’s a driver. Nevada gives e-bike riders the same rights on the road as drivers, so a driver who turns across your path, drifts into the bike lane or opens a door into you can be held responsible. Others can share the blame: a rental company that handed you a bike with bad brakes, a manufacturer whose battery or frame failed, or a city or county that left a dangerous road defect unrepaired. Insurers will try to put the blame on you. We find every party who owes you and hold each one accountable.
What should I do after an e-bike or scooter accident in Las Vegas?
Get somewhere safe, call 911 and get checked out — even if you feel fine. Adrenaline hides injuries. Then protect your claim: photograph the scene, the vehicles and your bike; get names and numbers from the driver and any witnesses; keep the bike and your damaged gear as they are; and don’t give the other driver’s insurer a recorded statement. Call a lawyer before you sign anything. Surveillance video gets recorded over, so don’t wait.
Do I need liability insurance for an e-bike in Nevada?
Not by law. Nevada doesn’t require insurance, registration or a driver’s license for an e-bike that fits the state’s definition: Class 1, 2 or 3, with a motor of 750 watts or less. But not required isn’t the same as protected. If you hit a pedestrian or damage a car, you can be held personally responsible for the bill. Some homeowners and renters policies cover e-bike accidents and some exclude anything with a motor, so read yours or ask your agent. If your bike is faster or more powerful than the e-bike definition allows, different rules — including insurance rules — may apply.
Whose insurance pays if a car hits me on my e-bike?
Start with the driver’s. Every Nevada driver must carry at least $25,000 in bodily injury coverage per person, and that minimum can run out fast after a serious crash. If the driver has no insurance, not enough insurance or drives off, the uninsured/underinsured motorist coverage on your own auto policy may step in, even though you were on a bike. Medical payments coverage on your policy may help, too. Insurers rarely point these out. We dig through every policy that could apply.
Does it matter what class of e-bike I was riding?
It can. Nevada recognizes three classes: Class 1 (pedal-assist, the motor stops helping at 20 mph), Class 2 (throttle, tops out at 20 mph) and Class 3 (pedal-assist up to 28 mph). Bikes in these classes are treated much like regular bicycles. A modified bike that goes faster or has a bigger motor may count as a moped or other motor vehicle, and insurers can use that to argue against your claim. Keep the bike and its label — the class is usually printed on it.
How long do I have to file an e-bike accident claim in Nevada?
Usually two years from the date of the crash for a personal injury lawsuit. If a city, county or state agency is involved — say, a pothole or a broken signal caused your crash — notice deadlines can come much sooner. Don’t let the clock make the decision for you. The sooner we start, the more evidence we can save.
My crash was caused by road debris, potholes, or poor road conditions. Do I still have a claim?
Yes. You may have a strong claim against the city, county, or state responsible for maintaining the roadway. Nevada law allows these claims, but they have strict notice deadlines. Our team investigates thoroughly and has recovered compensation for clients injured by hazardous conditions across the state.
I wasn’t wearing a helmet. Does that affect my claim?
Nevada does not require helmets for adult e-bike or e-scooter riders, though Clark County (and cities like Henderson) mandates them for anyone under 18. Not wearing a helmet does not prevent you from filing a claim. However, the insurance company may argue your head injuries were worsened by the lack of one, which could reduce compensation for those specific damages under Nevada’s modified comparative negligence rules. We fight aggressively to protect your full recovery.
What if I was partially at fault?
Nevada follows a modified comparative negligence rule. As long as you are less than 51% at fault, you can still recover compensation (reduced by your percentage of fault). If you are 51% or more at fault, recovery is barred. Our attorneys minimize any fault assigned to you and maximize your award.
